Supervisors Rescind State of Emergency

OSAGE- Mitchell County Supervisors rescinded a state of emergency that was filed on May 21, 2013.  Supervisors rescinded the State of Emergency last week after County Attorney Mark Walk stated that a motion for summary has been filed on the Mark Evans versus Mitchell County lawsuit.

In October, Evans filed a lawsuit against the county claiming county officials did not use reasonable care to prevent his car from going into a sinkhole that was created by flooding back in May.

Evans was driving on Angle Road on May 26 when he ran into a snow fence that was placed 20 feet in front of a large sinkhole.  He says there was no other fencing or signage warning oncoming vehicles of the sinkhole.

Mitchell County was declared a disaster area in May due to the heavy flooding throughout the county.
