Sex assault trial ends with hung jury; 2nd trial set

Gavel & judge

Charles City, Iowa (AP) – A second trial has been scheduled for a Charles City man whose first trial ended with a hung jury.

Thirty-one-year-old Eric Hill was charged with sexually assaulting a woman in Charles City in August 2008. The case went to the jury on Friday afternoon, and members deliberated for nearly two hours. They resumed their work Monday morning but told the judge a little before noon that they couldn’t reach a verdict. Judge Rustin Davenport told them to continue trying, but later they told him again that a verdict was not to be reached.

Davenport then declared a mistrial and set another trial to begin Aug. 23.
