Iowa Supreme Court to meet in Charles City on April 4th

Des Moines, Iowa – The Iowa Supreme Court will be meeting at the 500 North Grand Auditorium in Charles City on Tuesday April 4th to hear oral arguments.

The court will be listening to the attorneys argue in the case of Spencer J. Ludman vs Davenport Assumption High School from the Scott County District Court.

Davenport Assumption is appealing a jury verdict that found the defendant’s negligence was responsible for injuries the plaintiff baseball player sustained when struck by a foul ball while he  was standing in an unprotected part of the visitor’s dugout at defendant’s baseball field.

The player’s attorneys suggest the appeal presents important issues regarding the safety of the facilities at which student athletes participate. The school’s attorneys suggest sponsors of sporting events face an avalanche of litigation if the limited-duty rule is discarded in this context.

The oral arguments are open to the public and will begin at 7 p.m. in the auditorium.

A public reception with the justices will follow the oral arguments in the school cafeteria.
