Plea Agreemens For Sexual Assault Cases Becoming More Common

Charles City, Iowa – Floyd County Attorney Rachel Ginbey is providing a new take on prosecuting sexual assault cases.

Ginbey says some sexual assault cases should be pleaded out and not go to trial.  One reason is re-victimization.


Ginbey says her view is based upon her experience since she started prosecuting sexual assault cases seven years ago.  She says part of the issue is a conviction is never guaranteed.


However, the downside:


Ginbey said not every case will be accustomed to a plea deal.  Some will go to trial but the decision depends on the victim’s age, state of the victim and evidence against the the perpetrator .  It will be weighed on a case-by-case basis.
