Charles City Parents File Wrongful Death Suit Against State, Call For Intersection Changes

Charles City, Iowa – Parents of a Charles City man have filed a wrongful death suit against the state just one day after another man was killed at the same location.

Thomas and Diane Houdek allege the state has been negligent in their handling of the Highway 218 and Quarry Road intersection after their son TJ’s death.

Attorney David Skilton represents the family.

 

He says the intersection is a trap because it doesn’t warn motorists it’s not a standard intersection.  

 

That intersection is in Jasper county at US 65 and Iowa 330.  The sign reads “intersection ahead, multiple fatalities, use caution.”  According to the DOT’s statewide intersection safety improvement candidate list, the intersection has the third worst crash severity ranking from 2012-2016. The Highway 218 and Floyd intersection doesn’t make the top 200.

The report, developed on May 31, 2017, uses total crashes, fatalities, major injuries and traffic volume to rank statewide intersections.  

Houdek was killed on July 17, 2016 when his Harley-Davidson motorcycle was struck by a semi at Floyd intersection.

 

Skilton says the TJ’s parents are asking for a speed reduction and signage.
